The OnlineDegrees.com I Got My Degree Dance Video Contest
Introduction: www.OnlineDegrees.com (“Sponsor”) is offering an online video contest (the “Contest”).
NO PURCHASE IS NECESSARY TO ENTER OR WIN. CONTEST VOID WHERE PROHIBITED BY LAW.
Eligibility: Contestants must be at least 18 years of age at the time of entry, and legal residents of the 50 United States and the District of Columbia. Void in Puerto Rico and where prohibited by law or regulation. The Contest is subject to all applicable federal, state and local laws. Any entries not eligible for any reason will be disqualified from winning any award or prize and ineligible entries may be deleted from www.OnlineDegrees.com. Any entry that is awarded a prize and is later determined to have been ineligible, will be required to return any prize of monetary or material value within 7 days upon notification of disqualification and ineligibility. Employees of OnlineDegrees.com and its subsidiaries, affiliated companies, agents, and their immediate family (defined as parents, spouse, children, siblings, grandparents), and all those with whom such employees are domiciled, are NOT eligible to participate in the Contest.
Entry Requirements: To enter the contest, visit /dance/ and submit an online video no longer than 1 minute.
You may only submit up to one (1) video total.
All video submissions must be between 12:00:01 a.m. Pacific Standard Time (“PST”) on July 25, 2011, and 11:59:59 p.m. PST on August 19, 2011 (the “Entry Period”).
Entries must be submitted in English. The contestant certifies that (a) he or she owns any and all materials submitted for the Contest and that he or she has all necessary rights and permissions to use such materials, without any restrictions or limitations on the contestant’s right to submit or Sponsor’s right to use the entry; (b) by entering into the Contest, the contestant is not contravening any provisions of the Copyright Act, including the fair use provision; (c) the entry does not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights; and (d) the entry is not offensive, obscene or inappropriate in any way. By entering, contestant agrees to and abides by the YouTube Terms of Service at http://www.youtube.com/t/terms.
Entries may not have previously won an award from Sponsor. All entries will be reviewed by Sponsor and Sponsor reserves the right to disqualify and choose not to display any entry it deems to be inappropriate, offensive or is not in keeping with Sponsor’s image, in its sole discretion.
Once a contestant has submitted a video for the Contest, such contestant agrees that Sponsor shall own the entry submitted (including all rights embodied therein) and that Sponsor and its designees may exploit, edit, modify, display and distribute the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party.
Judging: Judging criteria will include creativity and originality. Views and ratings on video entries may also be taken into consideration at Sponsor’s discretion. Grand Prize Winners and Honorable Mentions will be selected by the OnlineDegrees.com Editors. The winners will be selected on or about August 22, 2011. Sponsor reserves the right not to award a prize in the event it receives an insufficient number of eligible entries that meet the minimum judging criteria, as determined by Sponsor in its sole discretion. Sponsor will supervise the voting and judging. Contestants agree to be bound by these rules and the decisions of the judges, whose decisions are final.
Winner Notification: The Contest winner will be announced on August 19, 2011. The winner will be notified via e-mail. Potential winners must respond to their notification within 7 days of receipt or they will be disqualified and ineligible for any award. Potential winners will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within 14 days of issuance of notification or they will be disqualified. Noncompliance with the foregoing, these official rules, Sponsor’s inability to contact a potential winner within a reasonable time period or prize notification returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion, a runner-up may be notified.
By accepting any prize, the winner grants Sponsor and its designees the right to use his/her name, city and state of residence, likeness and biographical information in any and all media for any purposes throughout the world in perpetuity, without additional compensation, notice or permission, unless prohibited by law. If a winner requests confidentiality, only a first name and state will be provided.
Prizes: The Grand Prize winner will win an Apple iPad 2. Approximate Retail Value (“ARV”) of Prize: $499.00. The Prize is awarded “AS IS” and without warranty of any kind, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). All federal, state and local taxes and any other costs and expenses not specifically stated herein as being awarded are the winners’ sole responsibility. No transfer, assignment, cash redemption, or substitution of prize except by Sponsor who may substitute a prize with one of equal or greater value, at its sole discretion. Contestants may write Sponsor at the below e-mail address to obtain a list of prize winners; all other prize details are provided at the sole discretion of Sponsor.
Limitation of Liability: Sponsor and its affiliates will not be responsible for late, lost, stolen, misdirected, damaged, incomplete, or illegible entries; or entries that are lost due to computer, Internet, or electronic malfunction. Sponsor reserves the right to cancel or modify the Contest and award the prize through an alternate means if fraud or technical failure compromises the integrity of the contest, as determined by it in its sole discretion. Contestants agree that Sponsor, its promotion partners, affiliates, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this Contest or acceptance of or use or misuse of a prize or parts thereof. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. In addition, neither Google nor YouTube has any responsibility or liability regarding the Contest, and Contestants completely release Facebook of liability related to this Contest.
Governing Law; Venue: This Contest will be governed by the laws of the State of California without reference to its choice of law principles. The contestants agree to submit to the exclusive jurisdiction of the state courts located in San Mateo County in the State of California and the federal courts located in the Northern District of California, with respect to disputes hereunder.
